Overview: Dutch Labor Law course

📌 Types of Employment Contracts

The training explores the diversity of employment contracts in the Netherlands, including: 
• Permanent contracts
• Fixed-term contracts
• On-call contracts (zero-hours and min-max)
• Temporary agency work
• Payrolling
• Apprenticeship and internship contracts
• Freelance and contracting agreements   

Participants will learn about the legal requirements, advantages, and disadvantages of each contract type, as well as the appropriate contexts for their use. 

📌 Employment Conditions (Collective and Individual)

The course covers employment conditions governed by both collective labor agreements (CLAs) and individual contracts, including:
• Salary structures and holiday allowances
• Working hours and overtime regulations
• Leave entitlements (annual, parental, and other types)
• Clauses such as probation periods, non-competition, confidentiality, and financial penalties   

It also addresses the impact of the “Transparent and Predictable Employment Conditions” Act, effective from August 1, 2022, on employment contracts and practices. 

📌 Self-Employment (ZZP)

The training examines the use of self-employed workers (ZZP’ers) in the Netherlands, highlighting: 
• The legal distinction between employment contracts and self-employment agreements
• Risks of misclassification and potential consequences
• Criteria used by tax authorities and courts to assess the nature of the working relationship

Participants will gain insights into best practices for engaging self-employed professionals while ensuring compliance with Dutch labor laws. 

📌 Sick Leave

Dutch law mandates that employers continue to pay at least 70% of an employee’s salary during the first two years of illness. The training covers: 
• Employer obligations regarding sick pay and reintegration efforts
• Coordination with occupational health services (Arbodienst)
• Employee rights and responsibilities during sick leave 

This section ensures that participants understand the comprehensive sick leave provisions and their implications for both employers and employees.

📌 Dismissal Procedures

The course provides an in-depth look at the stringent dismissal procedures in the Netherlands, including:
• Valid grounds for termination (e.g., economic reasons, long-term incapacity, misconduct)
• Required permissions from the Employee Insurance Agency (UWV) or courts
• Notice periods and severance pay (transitievergoeding) 

Participants will learn how to navigate the complex dismissal landscape while minimizing legal risks.
